General terms and conditions

1. Definitions

  • Rondvaart Zwolle: The provider of canal cruise services in Zwolle's canals.
  • Participant: Any person taking part in a canal cruise organised by Rondvaart Zwolle.
  • Services: All canal cruise services offered by Rondvaart Zwolle, including but not limited to independent canal cruises and guided group canal cruises.

2. Applicability

  • These General Terms and Conditions apply to all services offered by Rondvaart Zwolle and to any agreement concluded between Rondvaart Zwolle and the participant.

3. Reservations and cancellations

  • Reservations for round trips can be made by phone, via the website or by e-mail.
  • If you wish to change the date of the scheduled cruise, you must change it via our contact form at least 7 days before the scheduled cruise. Cancellation is not possible unless cancellation insurance has been purchased during the ordering process.
  • When booking on location, you automatically agree to the terms and conditions upon payment.

4. Rates and Payment

  • The tariffs for the round trips will be communicated in advance via the website or on request.
  • Our rates include VAT and fuel costs. Unless otherwise agreed in writing, your payment must be made online at the time of booking. In case of late payment, we are entitled to cancel the booked cruise.
  • Payment should be made prior to the cruise, unless otherwise agreed.

5. Safety and Rules on Board

  • All participants must comply with the safety instructions and rules on board, as communicated by the crew or guide.
  • Everyone on board must follow the skipper's instructions. We reserve the right to end the cruise (prematurely) or deviate from the agreed route if the skipper's instructions are not followed or weather conditions require it.
  • Rondvaart Zwolle is not liable for personal injury or damage to personal property, unless this is the result of negligence by Rondvaart Zwolle.
  • Renting a boat through Rondvaart Zwolle is done at your own risk. The renter must report any damage, of whatever nature, or facts and/or possible damaging circumstances to us immediately. Continuing to sail after a collision is a crime and will be reported.
  • Damage to the rented boats and others can be recovered by the lessor from the lessee including all additional costs. (n.b. If you have a personal third-party insurance, in most cases this covers sailing with (rental) boats up to 4hp. Check your own policy conditions).
  • Unless it is due to intent and/or gross negligence of (the employees of) Rondvaart Zwolle, Rondvaart Zwolle accepts no liability for damages resulting from death, injury, accidents, injury, loss or theft caused to the participant(s) during or as a result of the activity or package.

6. Rules of conduct and consequences of non-compliance

  • Hirer handles the sloop and accessories with care and has sufficient sailing knowledge and skills to navigate the water safely. Hirer must comply with the legal boating regulations, such as maximum speed and a sober skipper.
  • Hirer will treat the boating environment (banks, local residents and other boats etc.) in a respectful manner. We reserve the right, without any form of refund, not to hand over the boat or to end the cruise early if any of these rules are violated. This consideration lies entirely with us as lessor and no discussion is possible.
  • The boats and any rented cooler(s) should be handed over clean and debris-free upon return on before the end of your time slot.
  • Is your boat dirty: Come back earlier so there is time to clean it for the next tenants.

7. Changes and cancellations by Zwolle Canal Cruises

  • Rondvaart Zwolle reserves the right to change or cancel roundtrips due to bad weather conditions, technical problems or other circumstances beyond its control.
  • In case of cancellation by Rondvaart Zwolle, an alternative date will be offered or a full refund will be made.

8. Complaints

  • Complaints about the services of Rondvaart Zwolle should be made in writing, stating reasons, within 48 hours of the cruise.
  • Rondvaart Zwolle aims to deal with complaints within 14 days of receipt.

9. Privacy

  • Personal data of participants will be processed in accordance with applicable privacy legislation and the privacy statement of Rondvaart Zwolle.
  • When you do a canal tour with us or rent a boat (incl. sups) from us, you give us permission to use images (photo and video) you are in for marketing and communication purposes.

10. Final provisions

  • These General Terms and Conditions and all agreements between Rondvaart Zwolle and the participant are governed by Dutch law.
  • Disputes will initially be resolved by mutual agreement. If this does not lead to a solution, the dispute will be submitted to the competent court.
